The Supreme Court has rejected the request of Chief Presidential Counselor Juan Ponce Enrile to dismiss the plunder case against him, which involved his alleged involvement in the Priority Development Assistance Fund (PDAF) scam.

“The prosecution must be given the opportunity to present evidence as it sees fit and in accordance with law and rules,” the Supreme Court ruled in its decision, authored by Justice Maria Filomena Singh.
“It has the right to determine what evidence should be presented, when and for what purpose,” it added.
Enrile's petition asked the Supreme Court to dismiss his plunder case because of the Sandiganbayan's refusal to grant his pleas requesting that the memorandum of explanation of facts be included in the preliminary injunction and that the prosecution's evidence be limited to the memorandum of explanation of facts.
