The Supreme Court has ruled that the local government of Quezon City cannot seize and sell the properties of the Manila Seedling Bank Foundation for failing to pay real estate taxes.
Conflict between NHA and QC city government over Manila Seedling Bank escalates
The SC Public Information Office (SCPIO) reported on Thursday (August 8) that the Supreme Court issued a ruling, dated July 30 and authored by Justice Ramon Paul Inting, in favor of Manila Seedling Bank.
“The Court held that the City had no authority to reclassify the property for a use other than that originally intended in Proclamation No. 1670, a national law,” the SCPIO said.
“The court also ruled that the city cannot seize the property for non-payment of property taxes as it is owned by the NHA (National Housing Authority), a tax-exempt institution,” it added.
